Some clients believe that it is in their best interest to investigate and settle claims at the earliest possible moment. Particularly in some service industries, there is a reluctance to fight liability for business reasons. In those instances, we work with the client to develop claims administration procedures that are consistent with the client’s goal. Such an investigation serves the function of showing the claimant that the client takes their injury seriously, and does not minimize the event. It also provides a basis for the next step in the claim resolution process. Where it is determined that our client is not responsible for the accident, a denial letter is sent informing the claimant of this and the reason why. At all times, the claimant is treated with respect. After all, he or she is your customer and when treated respectfully will be more willing to continue purchasing your goods or service. These clients recognize that plaintiff lawyers soon learn which companies settle – and which does not.
